Merck Facing Federal Fraud Charges in MMR Vaccine Scandal...

Finally! Merck may be dragged before Congress for one of its many, many (many) criminal acts.

Thanks to Lawrence Solomon of Canada’s National Post, the court filings in this case have been posted online:

According to a whistleblower in the case, Merck:

(i) failed to disclose that its mumps vaccine was not as effective as Merck represented

(ii) used improper testing techniques

(iii) manipulated testing methodology

(iv) abandoned undesirable test results

(v) falsified test data

(vi) failed to adequately investigate and report the diminished efficacy of its mumps vaccine

(vii) falsely verified that each manufacturing lot of mumps vaccine would be as effective as identified in the labeling

(viii) falsely certified the accuracy of applications filed with the FDA

(ix) falsely certified compliance with the terms of the CDC purchase contract

(x) engaged in the fraud and concealment for the purpose of illegally monopolizing the U.S. market for mumps vaccine

(xi) mislabeled, misbranded, and falsely certified its mumps vaccine

(xii) engaged in the other acts to conceal the diminished efficacy of the vaccine the government was purchasing.

I read the entire court filings in this case last night:

Every one of you needs to do the same. If any of those allegations prove true, Merck IS in fact psychopathic – textbook psychopathic.

They are like some villain out of the Batman comics, a caricature of evil that you would never imagine exists in real life.

But they do.

Kenneth C. Frazier does.

And they will continue to exist until consumers across the globe stand up and say, We’re mad as hell and we’re not going to take it any longer.

Yes, excellent point: All those people out there who continue to insist Merck is innocent – and that there’s no way Propecia could cause PFS – need to see Merck’s true colors.

Note the updates at the end of the story: Merck’s spin is that the suit had no merit because the federal government chose not to sue as well. But then the attorney for the whistleblower slams it back in Merck’s sick, twisted face:

[UPDATE: Kellie Lerner, who represents vaccine purchasers, sent us this note: “Contrary to Merck’s assertions, the Department of Justice has submitted documents to the court affirming its ‘strong interest in the outcome’ of the case, and clarifying that its decision not to intervene ‘should not be interpreted as a comment on the merits.’ More importantly, the government has preserved its right to intervene later in the proceedings. Based on the government’s submissions to the court, we take issue with any assertion that the government has definitively concluded to not pursue this case.”]

[ANOTHER UPDATE: Keller Grover and Constantine Cannon, lawyers who represent the whistleblowers, wrote this: "We disagree with Merck’s assertion that the government was aware of and resolved the issues raised in the lawsuit. As the district court made clear in its decision, the whistleblowers ‘allege that their former employer fraudulently misled the government and omitted, concealed and adulterated material information regarding the efficacy of its mumps vaccine… (includin) deliberately obfuscating or providing incomplete information to the FDA.’ "]

Anyone with kids, please send the links within the posts about the Mumps vaccine scandal to the Principal and Healthcare nurse at your local public school. I would say this is a valid health alert and all Parents should be notified.

Edit: I just sent the links to the Pediatric Doctors office where my kids are treated.

Now if we only had, say, $1 million for a Merck awareness campaign, we could no doubt save a slew of lives from the incessant evils of Darth Frazier.

Oddly, though the story racked up 608 comments, the Huffington Post appears to have close the comments. So no one else can leave a comment. Nor can one (or at least I can’t) even read the existing comments.

But I did go over a lot of them a few days back and the general public appears to be furious at Merck.

If we can get 1,000 comments by the end of this week, not only will Merck take note, but The Huffington Post as well – and in turn will be more likely to cover Merck-malfeasance stories in the future.
