But another thing to be aware of is that, a few months back, the federal judge in this case ordered most all of the cases back to state courts, a move that would have cost Merck tens of millions of dollars more in legal fees.

Yes, this was a major move by the judge, one that no doubt put pressure on Merck to settle. Again, the NuvaRing litigation, which is set to begin in January, will say a lot about how Merck is going to handle lawsuits going forward, particularly since most of the NuvaRing cases are consolidated in a single court.

Agreed: unfortunately, Merck thinks it’s playing fantasy football here – it’s all some big game with chits on either side of the ledger.

But we’re talking about hundreds of thousands of lives that have been decimated by Merck products.

And when that’s the case, ethics and humanity should be the governing force.
